Guidelines for compounding of offences under Customs (Compounding of Offences) Rules, 2005-regarding.

Adequate publicity may be given about reduction of compounding amount, in order to make the scheme more popular as to reduce the cases pending in the Court. Further, in order to make best use of compounding of offence scheme, all persons against whom prosecution is initiated or contemplated, should be informed separately in writing, the offer of compounding. Guidelines issued vide Circular No.54/2005-Cus dated 30.12.2005 shall continue to apply, subject to the amendments made vide Notification No.118/2008-Customs (NT) dated 12.11.2008 and the changes mentioned in para 5 above.

Contimeters Electrical Pvt. Ltd 317 ITR 249 (Del)- Tribunal had arrived at the correct conclusion that the requirement of filing of audit report along with the return was not mandatory but directory and that if the audit report was filed at any time before the framing of the assessment, the requirement of section 80IA(7) would be met.

A Double Taxation Avoidance Agreement was signed between India and Tajikistan today, i.e. 20th November, 2008. The Agreement was signed by Mr. Narendra Bahadur Singh,Chairman, Central Board of Direct Taxes on behalf of Government of India and by Mr. Norinov Jamshed Nurmahmadovich, Deputy Minister of Finance of the Republic of Tajikistan on behalf of the Government of Tajikistan.

The Income Tax Department seeks suggestions on e-filing of I-T returns for the AY 2009-10 to make the e-filing website, software and functionalities more user-friendly and robust. Apart from general suggestions, specific suggestions on website look and feel, functionalities and facilities, white papers and technical papers are also welcome. Technical suggestions on XML schema, digital signatures, security, web services are also solicited. Suggestions and documents (in word format preferably) may be sent to efilingsuggestions@gmail.com .

In exercise of powers conferred by Section 5, read alongwith Section 3(2) of the Foreign Trade (Development and Regulation) Act, 1992, also read alongwith paragraph 2.1 of Foreign Trade Policy, 2004-09, the Central Government hereby extends the validity of prohibition on import of milk and milk products under Chapter 4 of ITC(HS) from China vide Notification No.46/(RE 2008)/2004-2009 dated 24th September, 2008 by another six months from 24.12.2008 upto 23.6.2009.

In exercise of the powers conferred by Section 5 read with Section 3(2) of the Foreign Trade (Development & Regulation) Act, 1992 (No.22 of 1992) and also read with Para 1.3 and Para 2.1 of the Foreign Trade Policy, 2004-2009, the Central Government hereby amends, with immediate effect, Schedule-II of ITC (HS) Classification of Export and Import Items, 2004-09, as amended from time to time, by inserting Chapter 4.

The import / export of rough diamond (HS Code 7102.10, 7102.21 or 7102.31) from / to Venezuela shall be prohibited in view of voluntary separation of Venezuela from the Kimberley Process Certification Scheme (KPCS). No Kimberley Process Certificate shall be accepted / endorsed / issued for import and export of rough diamonds from / to Venezuela.
