RTI – CIC has no power to direct Public Authority to furnish information – SC

Chief Information Commissioner and another Vs. State of Manipur and another (Supreme Court)- Government of Manipur has notified the exemption of certain organizations of the State Government from the purview of the said Act.This Court makes it clear that those notifications cannot apply retrospectively. Apart from that the same exemption does not cover allegations of corruption and human right violations.

Delhi HC stays CIC Order asking RBI to reveal name of defaulters

The Delhi High Court today stayed the direction of the Central Information Commission (CIC) asking the Reserve Bank of India to provide details of industrialists who have defaulted in repayment of loans taken from nationalised banks. A bench of Justice Vipin Sanghi, in its interim ex parte order, asked the information-seeker to respond to the petition filed by the RBI challenging the CIC order.

CIC directs RBI to disclose names of top 100 loan defaulters

The Central Information Commission has directed the Reserve Bank of India to make public the names and other details of top 100 industrialists of the country who have defaulted on loans from public sector banks. The Commission also directed the central bank to post on its website complete information on all such industrialists as part of suo motu disclosure mandated under section four of the RTI Act before December 31 and asked it to update it every year.

Information furnished to I-T not come under fiduciary relationship and cannot be denied to an RTI applicant

Information given to Income Tax authorities by assesses does not come under fiduciary relationship and cannot be denied to an RTI applicant on that ground, the Central Information Commission has held. The transparency panel while hearing the plea of Rakesh Kumar Gupta, who had sought to know about estimated tax evasion figure, rejected the contention of Income Tax department that the information is held in fiduciary relationship.

Central Information Commission (CIC) has drawn the attention of the CMD of the State Bank of Bikaner & Jaipur to the issue of sanctioning of applications under Pradhan Mantri Rozgar Yojana (PMRY) and to revisit the matter and direct branch managers of all branches of the bank in the state of Rajasthan and outside the State to review the reasons for turning down applications made under PMRY. Make public RBI advisory note issued to ICICI – CIC

The Central Information Commission (CIC) has directed the Reserve Bank of India to disclose an advisory note it issued to ICICI Bank for alleged violation of any RBI guidelines or for contravention of the provisions of money laundering and foreign exchange acts. The case relates to an RTI application filed by SS Vohra, who had sought to know details of such advisory notes issued by the apex bank to Patna and Hong Kong branches of ICICI Bank.

Annual Confidential Reports of government officials not personal, says CIC

Annual Confidential Reports of government officials are not personal information and they should be provided to the public under the Right to Information Act, the Central Information Commission has held.The case relates to RTI applicant V R Sharma who had sought detail of ACRs of about 17 officials including his own, but the Labour Ministry allowed him access to only his ACR.
