As per the Section 139AA of the Income-Tax Act, 1961, as introduced by the Finance Act, 2017, it is mandatory to quote Aadhaar Number/Aadhaar Enrolment ID, in order to file income tax returns, and for submitting an application for Permanent Account Number

But this section is applicable for those person who is eligible to obtain Aadhaar number as per the Aadhaar Act, 2016.

According to Aadhaar Act, 2016 only a resident who has resided in India for a period or periods amounting in all to 182 days or more in the 12 months immediately preceding the date of application for enrolment is eligible for Aadhaar.

Therefore, the Section 139AA of the Income-Tax Act, 1961 shall not apply to those individuals who are Non Residents Individuals (NRIs) since they are residing in India for less than 182 days.

Hence to conclude at the end it is not mandatory for Non Resident Individuals (NRIs) to link Aadhaar with PAN and therefore the above mentioned consequences will also be not applicable to them.

Without giving proper time the department does this with immediate effect. It gives lot of problem. For example I could not update my own profile with my own telephone no and email id, since I have used these for more than 3. Atleast the department should have listed who are all the others and a facility to delete some and retain the three. Now I am blindfolded and I could not update my own number and email id.
