THREE TO FOUR YEARS RIGOROUS IMPRISONMENT TO THEN INCOME TAX OFFICER AND THREE OTHER PUBLIC SERVANTS IN SEPARATE CASES OF BRIBERY

The Special Judge, Anti Corruption, Court No.3, Lucknow (Uttar Pradesh) has convicted Sh. U. P. Yadav, then Income Tax Officer; Sandeep Mohan Dubey, then Office Superintendent and Gore Lal Mishra, then Tax Assistant in a bribery case and sentenced them to undergo four years Rigorous Imprisonment with fine of Rs. 50,000/- each.

CBI had registered a case on 03.08.2010 against Sh. U. P. Yadav, Income Tax Officer, Sh. Sandeep Mohan Dubey, Office Superintendent and Sh. Gore Lal Mishra, Tax Assistant, all working in Income Tax Department, Orai, Jalaun (Uttar Pradesh) on the allegations of demanding bribe of Rs.10,000/- for extending favour in setting the tax matter against wife of the complainant in connection with purchase of an agricultural land. CBI laid a trap and arrested accused Sandeep Dubey, Office Superintendent while demanding & accepting bribe of Rs.6000/- in conspiracy with U. P. Yadav, ITO and Gore Lal Mishra, Tax Assistant. A chargesheet was filed against the three accused persons on 01.10.2010 u/s 120 B of IPC and 7 & 13(1)(d) of PC Act, 1988 in the court of Special Judge, Anti Corruption, Court No. 3, Lucknow.

In another case, the Special Judge for CBI cases, Tis Hazari, Delhi had convicted Sh. Devraj, then Head Constable, Police Station Kanjhawala, Delhi in bribery case and sentenced him to undergo three years Rigorous Imprisonment with fine of Rs.15,000/-.

This case was registered on 02.04.2013 on a complaint alleging therein that Sh. Devraj was demanding a bribe of Rs. 10,000/- from the complainant for releasing the vehicle which was seized and kept in Police Station Kanjhawala, Delhi. The accused was caught while demanding & accepting the bribe. CBI filed chargesheet on 02.11.2013 in the Competent Court, Delhi.

The Trial Court found the accused persons guilty and convicted them.
